Bayer Gains Momentum After US Signals Support in Glyphosate Lawsuit

02 December 2025, GermanyBayer’s stock rose sharply in Frankfurt on Tuesday after the US government recommended that the Supreme Court review the company’s appeal in a Roundup-related lawsuit.

The company is seeking to overturn thousands of US claims alleging that its glyphosate-based herbicide causes cancer. Bayer maintains that Roundup is safe when used as directed and notes that the US Environmental Protection Agency (EPA) has repeatedly approved labels for glyphosate products without cancer warnings.

US Solicitor General Recommends Review

The increase in Bayer’s share price followed a brief submitted by US Solicitor General D. John Sauer. In the filing, Sauer advised the US Supreme Court to take up Bayer’s challenge to a Missouri jury verdict that awarded $1.25 million in damages to plaintiff John Durnell. The case argued that Roundup exposure contributed to the plaintiff’s non-Hodgkin’s lymphoma and that the company did not adequately warn consumers of risks.

Bayer’s appeal centres on its position that federal pesticide regulations should take precedence over state-level warning requirements. Sauer’s brief noted that the EPA has “ repeatedly determined that glyphosate is not likely to be carcinogenic in humans” and has approved Roundup labels without cancer-related warnings.

Bayer Welcomes the US Government’s Position

Bayer CEO Bill Anderson said the support from the US government was “an important step” and “good news for US farmers, who need regulatory clarity.” He added that the company believes the issue has significant implications, stating, “The stakes could not be higher as the misapplication of federal law jeopardises the availability of innovative tools for farmers and investments in the broader US economy.”

A formal decision from the Supreme Court on whether it will hear the case is expected by January.

Background on the Litigation

Bayer took ownership of Roundup after acquiring Monsanto in 2018. The company has faced tens of thousands of lawsuits in the United States and has spent more than $10 billion on settlements and verdicts related to the product. In 2022, Bayer began replacing the home-use formulation of Roundup with a non-glyphosate version.
