Delhi High Court Restrains Mass Crop Science from Using Deceptively Similar Packaging to BASF’s ‘Tynzer’ Herbicide

14 July 2025, New Delhi: The Delhi High Court has issued an interim order restraining Mass Crop Science Private Limited from manufacturing, selling, or distributing its product ‘Khanjar’, citing deceptive similarity in trade dress to BASF SE’s trusted herbicide Tynzer.

In the case CS(COMM) 622/2025, BASF filed a suit seeking a permanent injunction to stop the infringement of its registered trademark and product packaging. Hon’ble Justice Amit Bansal, who presided over the matter, noted that the overall appearance of Khanjar closely resembled Tynzer, which could potentially mislead farmers.

Earlier, on June 20, 2025, the Court had passed an ex parte ad interim injunction and appointed a Local Commissioner to inspect the defendant’s premises. The Commissioner’s visit revealed substantial stock of products bearing the allegedly infringing trade dress.

Responding to BASF’s concern that these products might be circulated in the market, the Court, on July 9, 2025, extended its interim order. The defendant—including its directors, employees, agents, distributors, retailers, and all affiliated parties—has been restrained from directly or indirectly manufacturing or selling any product bearing the impugned trade dress, including those seized during the inspection.

Notice has been issued to the defendant through all permissible modes, with directions to file a reply within four weeks. The rejoinder, if any, must be filed within two weeks thereafter.

The matter is now listed for hearing on July 23, 2025.
