Delhi High Court Stops Sale of Counterfeit Dhanuka Agrochemicals by Agrim Wholesale

Court restrains Agrim Wholesale from selling counterfeit agrochemical products under the ‘Dhanuka’ brand and orders removal of listings within 72 hours.

03 October 2025, New Delhi: The Delhi High Court has granted interim relief to Dhanuka Agritech Limited in a trademark infringement suit against Agrim Wholesale Private Limited and other unidentified parties. The order, passed by Hon’ble Justice Tejas Karia, restrains the defendants from unauthorized use of the “DHANUKA” mark and other registered trademarks of the company.

The case, filed under CS(COMM) 1056/2025, sought a permanent injunction against infringement, passing off, dilution, and unfair competition, along with damages, rendition of accounts, and delivery up of infringing products.

The Court acknowledged Dhanuka Agritech’s established reputation and statutory compliance in the agrochemical industry. With four ISO-certified manufacturing facilities and a revenue of ₹2,035 crore in FY 2024-25, the company is a trusted name among farmers, distributors, and dealers nationwide.

According to Dhanuka, Agrim Wholesale was selling counterfeit and unauthorized agrochemical products under its marks in violation of the Insecticides Act, 1968 and the Insecticides Rules, 1971. Despite presenting itself as an intermediary, Agrim allegedly marketed low-quality infringing goods through its mobile application under both an “Infringing Products” category and a “Popular Brand Category,” misleading buyers and damaging Dhanuka’s goodwill.

In response, the High Court issued an ex-parte ad-interim injunction prohibiting the defendants from using Dhanuka’s marks or any deceptively similar variants. The order also prevents them from selling, soliciting, advertising, importing, exporting, or offering for sale any counterfeit products bearing the company’s branding, including via e-commerce channels. Further, the defendants have been restrained from engaging in activities that could mislead consumers or dilute Dhanuka Agritech’s reputation.
