Brazil’s Agriculture Ministry Provisionally Reinstates Syngenta’s Engeo Pleno S After Court Steps In
15 October 2026, São Paulo: Brazil’s Ministry of Agriculture and Livestock (MAPA) has provisionally reinstated the registration of Syngenta’s widely used insecticide Engeo Pleno S, publishing Ato (Act) No. 63/2026 in the Diário Oficial da União (Brazil’s Federal Official Gazette) on October 13, 2026, after a federal court suspended the ministry’s own cancellation of the product less than a week earlier.
The product, registration number 06105, combines thiamethoxam and lambda-cyhalothrin and is used against insect pests in crops including soybean, corn and cotton. MAPA had cancelled the registration through Ato No. 59/2026, signed September 17 and published September 18, 2026, closing out an administrative proceeding (case No. 21052.023531/2021-78) that dated back to 2021 over production lots found to have a composition different from the formula originally authorized. The case was reviewed by Brazil’s Special Commission for Agricultural Defense Appeals (CERDA), which in Decision No. 90/2026 partially upheld Syngenta’s appeal but kept the cancellation in place, and separately, in TAC Decision No. 5/2026, rejected the company’s request to convert the penalty into a fine paired with a Conduct Adjustment Agreement (TAC) instead of losing the registration outright.
Syngenta challenged that outcome in court through a writ of mandamus. On October 6, 2026, Judge Leonardo Tocchetto Pauperio of the 16th Federal Civil Court of the Federal District in Brasília granted a preliminary injunction suspending the cancellation’s effect on registration 06105 and ordering CERDA to reconsider, within 10 business days, Syngenta’s request to substitute the cancellation with a fine and TAC. The judge found that CERDA had not adequately justified its earlier rejection of that request, though the ruling does not force CERDA to grant it; the commission can still maintain its denial if it provides sufficient reasoning this time.
The sequence of actions in the case runs as follows:
| Date | Action |
|---|---|
| 2021 | Administrative case opened (No. 21052.023531/2021-78) over an unauthorized formula change |
| September 17-18, 2026 | MAPA signs and publishes Ato No. 59/2026, cancelling registration No. 06105 |
| October 6, 2026 | 16th Federal Civil Court grants a preliminary injunction suspending the cancellation |
| October 7, 2026 | Syngenta resumes production, sale and distribution under the injunction |
| October 13, 2026 | MAPA publishes Ato No. 63/2026, provisionally reinstating the registration |
With the registration provisionally restored, Syngenta, its distributors and farm cooperatives can resume producing, importing, exporting, selling and distributing Engeo Pleno S while the injunction stands, and stock already sold to farmers can continue to be used up to its expiry date according to the label. States that had separately suspended the product in line with the federal cancellation, including Sao Paulo, are now reversing those suspensions. The picture is not uniform nationally, however: Mato Grosso do Sul’s state agricultural defense agency, Iagro, suspended the product’s state-level registration in September, and no confirmation that it has followed MAPA’s reinstatement had surfaced as of October 14, so growers there should check directly with Iagro before resuming use.
Brazilian regulatory commentators have been careful to note that the reinstatement is provisional, not a final resolution. It does not erase the underlying finding of an infraction or Syngenta’s administrative liability, and CERDA’s fresh decision on the fine-and-TAC request, due within the court’s 10-business-day window, could still go against the company
