CPDA Welcomes Supreme Court Decision Providing Certainty for Crop Protection Investment and Competition

30 June 2026, Arlington: The Council of Producers & Distributors of Agrotechnology (CPDA) today welcomed the U.S. Supreme Court’s decision in Monsanto Co. v. Durnell, which held that the Federal Insecticide, Fungicide, and Rodenticide Act expressly preempts a state-law failure-to-warn claim that would require a pesticide warning different from the label approved by the U.S. Environmental Protection Agency.

In a 7-2 decision, the Court recognized the uniform federal framework Congress established for pesticide labeling. EPA is responsible for evaluating pesticide safety, determining which warnings are necessary and approving the labels manufacturers must use unless and until the agency approves or requires a change.

The certainty provided by the decision extends beyond a single company or product. Glyphosate is a widely used, post-patent active ingredient supplied through a broad and competitive marketplace that includes numerous generic products. Farmers depend on that competition to preserve choice, manage input costs and maintain access to proven crop protection tools.

“Consistent, science-based federal labeling is essential to a competitive crop protection marketplace,” said CPDA President and CEO Terry Kippley. “The certainty provided by this decision gives companies greater confidence to invest in product registrations, stewardship, U.S. manufacturing capabilities and the crop protection tools farmers will need in the future.”

CPDA supports rigorous, transparent, and science-based pesticide review by EPA, including the agency’s authority to require label changes when warranted. The decision reinforces this uniform federal labeling framework while noting that states retain authority under FIFRA to regulate the sale or use of federally registered pesticides.
